Assessment of paintings by Chinese-Paintings.com is subject strictly to our terms and conditions contained at Chinese-Paintings.com and the terms and conditions contained in our Assessment document (including attachments, footnotes, head notes), if any.

As assessment of paintings is not a science and subjective in nature, Chinese-Paintings.com or our experts/personnel do not warrant the accuracy or correctness of the assessment. All indication of value(s) will be in US$ and within a certain range of prices, and shall be strictly regarded as an estimation, an indication or a guide rather than a true valuation. The Assessment shall be strictly for your own usage and information, and shall not be divulged, circulated, forwarded and/or otherwise published to third parties without our express written consent. It must be noted that our assessment of any work is usually based on soft formats (eg. jpg or gif) emailed to us, and there is no actual physical inspection of the subject painting or work. Accordingly, the Client should recognize the limitation of such an assessment as our expert has no opportunity of physical examination.

For the purposes of any Assessment, it is assumed that (1) the Client owned the painting provided for assessment, (2) the painting is genuine, and (3) all representations by Client are accurate and correct.

The Client in relying on our Assessment shall acknowledge that our Assessment is not a strict valuation per se, but an indication or estimation only. The Client acknowledges that Chinese Paintings have a long history, and it is impossible to have a strict or formal valuation, as each painting is unique and differ in terms of artist, age of painting, stroke, paint, nature, origin, medium, condition, market condition, country and a whole host of other factors.

Each buyer and seller has different consideration in purchasing or selling a painting (as the case may be), and some are prepared to offer more or less depending on their own personal considerations.

Chinese-Paintings.com (or its webmasters, agents, principals, staff or experts) does not warrant or represent the accuracy of any part or parts of this Assessment or the accuracy of any price or price range stated. Our Assessment of any painting if commissioned by our Client, although made in good faith, is subject to error of judgment, mistake, omission, negligence or error of any nature, and the Client shall accept these as inherent risks in obtaining or commissioning Chinese-Paintings.com.

Chinese-Paintings.com (or its webmasters, agents, principals, staff or experts) disclaim all liabilities in respect of this Assessment, including your reliance thereof, and reserve all rights to claim against the Client for all damages, and costs and expense on a full indemnity basis if a claim against us (or its webmasters, agents, principals, staff or experts) is made in breach of the terms herein. This contract or terms shall be construed in accordance with the laws of England & Wales, and the Client shall submit to the non-exclusive jurisdiction of the Courts of England & Wales..

In the event that Chinese-Paintings.com (or its webmasters, agents, principals, staff or experts) is found to be liable in respect of its assessment (which is denied), its/his/her/theirs liabilities (if any) shall be limited to the amount paid by the Client to Chinese-Paintings (or its principals) in providing the assessment service and not otherwise.

If you are using our offline sale service, we will require an Authority to Act in the sale as your agent, and you agree to pay our current commission rate upon conclusion of the sale. You warrant that the painting to be entrusted to us for sale is original and you are the owner or duly authorized to trade in it, and you shall fully indemnify us for all liabilities in the event of any breach of the terms herein. All additional disbursements and expense (which will be informed to you for prior consent) if required to be incurred will be borne by you.

4. Unless stated otherwise, products which are for auction on this site do not belong to us, and posted by third parties' users of this site, and any intended bids for products listed at our Auction site or any part thereof are strictly at your perils and risk. As such, for products listed at our Auction site that do not belong to us or our associates or affiliates, we do not warrant that the products to be auctioned through this site will correspond to the description given, nor will be of satisfactory quality. We exclude all other warranties, express or implied, in respect of the products. You are specifically warned to take extra care in verifying all aspects of the products.

5. The winning bid in any auction will be the offer accepted and which where applicable, meets any other conditions stated as applicable to a particular auction. The price of the winning bid is exclusive of any tax, shipping costs, and other charges.

6. Bids may be refused or removed, including those in respect of which there is dispute or which fail to reach the reserve price (where applicable). All products listed by Listees may be removed or edited at our sole absolute discretion.

7. Auctions may be closed early or extended at any time. Auctions may be cancelled or listings withdrawn because of, amongst other things, technical difficulties.

8. Upon the conclusion of the sale and purchase between the Seller and the highest Bidder and receipt of the Bid Price (means the concluded price), the Seller and shall pay 15% of the Bid Price to Chinese-Painting immediately. We do not monitor payments by Buyer nor the delivery of the goods sold via our Auction system, and the Seller and Buyer shall make the necessary arrangement thereto.

Neither we nor our principals, agents or associates accept any liability for any losses or claims arising from any inability to access the web site, any interruption in the conduct of any auction or any failure to complete a transaction.
